Key terms at a glance

Contract conclusion (section 2)
A paid contract is concluded as soon as the payment has been processed successfully by the payment provider. The licence key is sent by email as confirmation. The free tier does not create a paid contract. Registration requires a minimum age of 16.
Consumers only (section 1a)
Our offer is addressed exclusively to consumers. We do not currently conclude contracts with businesses. Prices shown are final prices. As a small business under Section 19 of the German VAT Act (UStG), no VAT is charged.
Data protection supervisory authority
The competent authority is Der Landesbeauftragte für den Datenschutz Niedersachsen (State Commissioner for Data Protection of Lower Saxony), Prinzenstraße 5, 30159 Hannover, Germany (postal address: Postfach 221, 30002 Hannover), [email protected], https://www.lfd.niedersachsen.de. You have the right to lodge a complaint there (Art. 77 GDPR).
Term and cancellation (section 5)
A monthly subscription runs for an indefinite period and renews monthly until cancelled. An annual subscription has a fixed term of twelve months, ends by itself and does not renew automatically. You can cancel at any time in your account or without logging in via the link Verträge hier kündigen at the bottom of every page. A cancellation takes effect at the end of the current billing period. Cloud data is then kept for a grace period of 30 days and deleted afterwards.
Right of withdrawal (section 6)
The software is a digital product that is provided immediately with your express consent; the right of withdrawal for the software expires when performance begins, provided you have confirmed this before purchase. For the ongoing Backup Guardian Cloud service the statutory withdrawal period applies; you owe a proportionate amount for the service already used. You can withdraw in your account under Settings, Subscription, with the button „Vertrag widerrufen“ (withdraw from contract) and a second confirmation step, or informally by email to support.
Liability (section 8)
Unlimited liability for intent, gross negligence and injury to life, body or health. For slight negligence only for breach of essential contractual obligations, limited to the foreseeable damage typical for this kind of contract. Statutory rights regarding defects of digital products remain unaffected. You remain responsible for keeping your own data backed up.
Applicable law (section 10)
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules of your country of habitual residence in the EU remain unaffected.
